A particulars in this Country from any Loures Shave to add that similar inconvenience has arisen regarding a Military man, Mr. Cracker of the 14 Batt"= Military Train, who arrived in this Country in April last, onboard the M. Ship "Sampson". It will therefore be desirable that enquiry should be instituted into that case also, as very serious results must endure and the ends of justice be defeated unless care is taken that every occasion when a Military Convict is sent Home from a Foreign Station for the Purpose of undergoing his sentence of Penal Servitude, the usual Papers (including the Judge's Order) are transmitted at the same time by the hands of the Officer or other responsible person who may have charge of such offender.

I am directed by Lee T. H. G. Lewis to transmit to you, for the purpose of being laid before The General Commanding in Chief, the enclosed copy of a letter from the Directors of Convict Prisons calling attention to the cases of five Military Convicts who were sent home from China in the "Marchioness of Londonderry" in August last and received into Millbank Convict Prison unaccompanied by the necessary Judge's orders: - and I am to request that you will inform him that these Convicts cannot be legally held in custody unless some warrant for their detention is forthcoming.
